-2- <br />5. At the Board's formal hearing on May 22, 1986, the Division's proposed <br />decision was presented to the Board. <br />6. The Mined Land Reclamation Division has found that the Meadows No. 1 <br />Mine successfully implemented the pit area backfilling and grading plan <br />approved by the Board on October 27, 1983 and is in compliance with <br />applicable regulations specified by law as demonstrated by the findings <br />document and on-site inspections. <br />7. Sun Coal Company requested a continuance to the August, 1986 Board <br />Hearing on issues concerning the haul road. <br />8. Mr. John A. Eilts raised the following issues at the hearing: <br />a) The post-mining topography is steeper than the pre-mining <br />topography. <br />b) The post-mining drainage pattern is different from the pre-mining <br />drainage. <br />c) Erosion on the backfilled area, the haul road, and off-site (due to <br />mining) remains a problem. <br />9. The Board finds that with respect to the above issues, the Board's <br />decision adequately addresses the requirements of the applicable <br />regulations and approved reclamation plan. The Board expressed concern <br />with respect to the erosion problems presented by Mr. Eilts. The <br />proposed decision of the Division also reflected these concerns. <br />Decision <br />Upon formal motion and by unanimous vote, the Board hearby affirms the <br />decision of the Division to release 60 percent of the bond applicable to the <br />pit area for successful completion of backfilling and grading. The dollar <br />amount of the bond reduction is $456,583.00. <br />Upon formal motion and by unanimous vote, the Board hereby continues the <br />portion of the hearing involving bond release for the haul road until the <br />August, 1986 Board meeting. <br />The Board's decision is based on a finding that the operation has complied <br />with all of the applicable requirements of the Colorado Surface Coal Mining <br />Reclamation Act, CRS 1978, 34-33-101 et seq and the Rules promulgated <br />thereunder. <br />
