Long <br />Drvaion Dneaor <br />During our meeting of October 14, 1993 at the G.E.C. mine, you expressed interest in <br />moving coal refuse aeeociated with the Black Diamond Mine into the Duck Pond Pit. A9 <br />you are aware, reclamation work ie currently in progress moving coal refuse on the haul <br />road designated ae G.E.C. disturbance into the Duck Pond Pit under RN-GOAL-MINES-8. The <br />Division ie only permitted to move G.E.C. coal material with the C.E.C. bond forfeiture <br />money. Per our conversation, you mentioned that the Corley Company would be interested <br />in moving coal refuse associated with the Black Diamond Hine into the Duck Pond Pit at <br />the expense of the Corley Company. The Division will allow for the removal of this <br />material into the Duck Pond Pit with the following conditions; <br />1) The proposed work will not be included, or any way associated with the bond money <br />allocated towards the C.E.C.- Orphan Pit- Coal Revocation Project. <br />2) work involved to move the Black Diamond material to the Duck Pond Pit must be by <br />agreement between the Contractor and the Corley Company. The Division of Minerals and <br />Geology will not be a party to this contract. The Corley Company shall be responsible <br />for the coat of this additional work. <br />3) The Division will add three (3j days on the bid project time for this work. <br />4) Material must be placed and compacted so ae to not interfere with the current <br />G.E.C. reclamation work and to meet the requirements in the Invitation to Bid Document, <br />such ae but not limited to slopes, drainage construction, and coal material within 20 <br />feet of the channel. <br />5) The Contractor remains responsible for assuring the final configuration of the <br />Duck Pond Pit ae stated in the Bid Document. The Project Manager will inspect and <br />verify the final configuration of the pit. <br />The Division requests that the Corley Company verify in writing that these conditions <br />will be met before moving any of the Black Diamond coal refuse into the Duck Pond Pit. <br />If you have any questions, please do not hesitate to call. <br />Sincerely, <br />~s <br />Erica S.
