Dear Mr. Ogrady:
On April 22, 1993, the Colorado Mined Land Reclamation Board voted to revoke the mining
permit and forfeit the reclamation bond associated with the Trinidad Basin Mine in Las Animas
County, Colorado. Reclamation of the remaining tlnreclaimed mining-related disturbances will
be conducted by the Colorado Division of Minerals and Geology. As part of this undertaking,
we would appreciate your assistance regarding two matters.
First, the Division is contacting all surface owners who currently own land within the revoked
permit boundary who may desire to comment on the reclamation project. As part of our efforts
to contact all appropriate landowners, the Division would appreciate your verification of the
boundaries of your property. Records from the Las Animas County Assessor's Office indicate
that you own the SW %. of the NE'/. of Section 15, T.31 S., R.65 W.; the W'/: of the SE'/. of
Section 15, T.31 S., R.65 W.; the NEy. of the NE%. of Section 22, T.31 S., R.65 W.; portions
of the SE'/. of the NE'/. of Section 15, T.31 S., R.65 W.; portions of the E'/: of the SE'/. of
Section 15, T.31 S., R.65 W.; and portions of the SY: of the NE'/. of Section 22. Please verify
these records and describe in greater detail which portion of the SEY. of the NEY. of
Section 15, the E'/: of the SE'/. of Section 15, and the SY: of the NE%. of Section 22 that you
own.
Second, reclamation of mining-related disturbances that pose a threat to public safety is our
immediate concern. Following revocation of the permit, Trinidad Basin Mining ceased
maintenance of the haul road bridge that spans Del Agua Creek, currently being used by
surface owners for access across Del Agua Creek. This bridge is being washed out due to
runoff from a natural stream channel that had been diverted during mining operations. The
Division proposes to reestablish the natural stream channel affecting this bridge so that its
drainage enters Del Agua Creek downstream from the bridge. (This proposed stream channel
relocation project is referenced on map "A").
