1" <br /> <br />In reference to Item No. 3: SUBMIT A LONG TERM SOLUTION WHICH WOULD ENTAIL <br />PERMITTING, BONDING, AND RECLAMATION OF THE SITE. REVEGETATION SUCCESS <br />CRITERIA SHOULD BE INCLUDED IN THE RECLAMATION PLAN. A POSSIBLE ALTERNATIVE, <br />IF DESIRABLE TO THE LANDOWNER, WOULD BE THE COMPLETE REMOVAL OF PROCESSING <br />WASTE AND FINAL DISPOSAL AT THE APPROVED DISPOSAL AREA NEAR HOTCHKISS. <br />WSC feels that permitting and bonding of the Crystal t4eadows site is not <br />necessary or required by applicable laws and regulations. This site had been <br />fully reclaimed and abandoned as a surface coal mining operation. WSC should <br />not be held responsible for activities of third parties on land which WSC does <br />not own. Therefore, tJSC does not feel consideration of a violation citation <br />is appropriate. However, WSC does wish to cooperate with the landowner and <br />CMLRD in remedying any immediate problem. <br />In summary, WSC recognizes that as a conscientious corporate citizen it has a <br />social responsibility to the residents and users of the North Fork area. We <br />do, however, feel that we have properly discharged our corporate <br />responsibilities at the Crystal Meadows site and are meeting with you today to <br />see if we can work out a solution to this problem that will be equitable to <br />all parties involved. <br />Respectfully Submitted, <br />WESTERN SLOPE CARBON, INC. <br />William J.
