<br />~Ci [CS MA7'fER, came before the Court upon for a heating on the Plaintiff s olaim for
<br />possession. The Court FIND5 xs follows:
<br />1. San ,loan Corp ac Landlord and Gold King Mines Corporation as tenant entered a lease on
<br />January Z3, ZOD4. The property leased is described as the northern 4.23 acres of the Herbert
<br />Placer, USMS No. 1352, more specifically described as: Beginning at Corner No. 1 of said
<br />Herbert Placer, whence U5LM Florence bears S79° 50' W., 53D.4 ft.; T7tence, N74° 15' Z;., 740
<br />ft. to corner No. 2; Thence, S 11 ° 17E, 293 fl along line 2-3 of said Herbert Placer; Tbenee, N81 °
<br />1D'G, 516 ft; I"hence, 582° 52'W, 149 ft; Thence, N86° 56'W, 49.5 $, to a point on line 5-1 of
<br />said i [erbert Placer; Thence N3' S9'W, 180 ft, to the point of beginning, situate in San .loan
<br />County, Colorado, hereinafter the Premises,
<br />2. Gold King Mines Corporation breached the terms of that lease In at Icast one significant way.
<br />3. Regarding the obligation of the tenant to provide electricity to the Quonset but in accordance
<br />with Paragraph 2(a) of the lease, the tenant failed to provide electricity during the lease tettn on
<br />at least two occasions. the second occasion occtitred in September of 2004, oiler a Notice of
<br />Default had been served and cared, There is no tight to cure the second violation in accordance
<br />with Paragraph 2(t) of the lease and C.R.S. 13-40-104(e.5). The Court find that this is a material
