Recommendation <br />I recommend approval by the Assistant Secretary--Land and <br />Minerals Management of the Bear No. 3 mine mining plan <br />modification for Federal leases D-052501 and C-42481. My <br />recommendation is based on the complete permit application <br />package (PAP). submitted by Bear Coal Company, Inc. (BCC) and <br />updated to April 13, 1989; an Environmental Assessment <br />prepared by the Office of Surface Mining Reclamation and <br />Enforcement (OSMRE); the Decision and Findings of Compliance <br />prepared by the Colorado Mined Land Reclamation Division <br />(MLRD); comments and concurrences of other Federal agencies; <br />and the administrative record. Pursuant to 30 CFR Part 746, <br />I have attached the decision document for the proposed <br />mining plan action. <br />The proposed mining plan action will authorize mining of <br />approximately 130,000 additional tons of Federal coal within <br />551 acres of Federal leases D-052501 and C-42481. The Bear <br />No. 3 mine mining plan was originally approved under the <br />Federal lands program on July 16, 1982, and was modified on <br />December 26, 1985. Since those approvals there have been no <br />modifications to the Bear No. 3 mine mining plan. With this <br />action, the Bear No. 3 mine mining plan area will contain a <br />total of 551 acres, including the previously approved mining <br />plan area for Federal leases D-052501 and C-42481. <br />Colorado Mined Land Reclamation Division (MLRD) reviewed the <br />PAP under the Colorado State program and the Colorado <br />cooperative agreement (30 CFR 906.30). Pursuant to the <br />Colorado State program and the cooperative agreement, <br />Colorado MLRD approved the PAP on April 13, 1989.
