Box 229 <br />Boulder, Colorado 80306 <br />RE: Amendment Application - Loadout <br />Bourg Coal Strip <br />Our File No. 79-125 <br />Dear Margie: <br />In order to clarify to yocl how this Division intends to handle the amendment <br />application recently submitted by Flatiron, I•would like to surrunarize our <br />telephone conversation of October 21, 1980. At that time, I infoT-ned you <br />that the amendment application will be considered complete, since a complete- <br />ness review was not performed within the 10 day time period allowed by the statute. <br />The filing date of t1Te application is therefore the date it was received in this <br />office, October 1, 1980. Since the application was filed prior to the effective <br />date of the Colorado state program, Flatiron is en*_itled to a review according <br />to interim standards, as specified in Section 34-33-109(3) of the coal Act. A <br />permanent program application will ofcourse also be required. <br />As I discussed laith you, althoLlgh the application is complete, it is nevertheless <br />seriously inadequate. A brief review of tiTe materials sL~bmitted revealed the <br />following deficiencies: ~ ' <br />1. The map which was submitted is unacceptable. Please provide a map which <br />shows the existing topography (I would suggest a two foot or five £oot <br />contour interval), as well as the location of sr reams or other nearby <br />features, such as roads, buildings or stockponds. <br />2. Additional information relative to the present condition of the site <br />should be supplied, including the nature and extent of the existing <br />disturbance. Is the road an existing road? <br />3. 17Te extent to which Flatiron intends to modify the site should be specified. <br />1Vi11 the road be improved? 19111 the area be regraded, or additional fill <br />material imported? Will any buildings or other structures be constructed? <br />4. A sediment control plan must be submitted, including direction of drainage, <br />and location and design calculations for any sediment ponds, culverts or <br />diversions. If the existing "impowulment" is to be used for sediment <br />control, it must be Lmgracled to meet design criteria. <br />5. Descriptive information must be provided relative to the land use, vegeta- <br />tion, and surface and ground water hydrology of the inunediately adjacent <br />
