We believe that the culvert installed by Harrison <br />Western to divert the clean water into Magpie Creek is undersised, <br />especially the 24" portion added to the 30" portion. We believe that <br />the erosion into the abandoned mine caused by the storm water discharge <br />from the original 30" portion has not been adequately sealed and <br />repaired. <br />According to preliminary data we have obtained, the 30" cmp will not <br />carry the peak runoff from a 300 acre plus watershed of a 10 year, 24 <br />hour event. You have indicated in the past that the 24" cmp portion is <br />inadequate. <br />There has not been any observation of any expected standing water or <br />evidence of a water line after any subsequent storms in the erosional <br />depression caused by the discharge from the 30" cmp. Therefore, it <br />seems likely that the small amount of concrete Harrison Western placed <br />in that area did not adequately seal the old mine. While the additional <br />24" cmp was placed over that depression, there is continued risk of <br />further degradation of that area from water flow in Magpie diversion <br />itself. We believe that the Magpie diversion channel should be repaired <br />to pre-culvert condition. <br />We have filed a suit to correct the culvert problem, but resolution of <br />that action will require many months.
