The following list responds to
each of your specific inquiries:
1. Yot1 asked for specifics related to when Kehn Construction can begin
mining ~~ccording to the Mineral Rules and Regulations of the Mined Land
Reclamation Board. Don Kehn Construction has obtained a Reclamation
Permit :From this agency for the Timnath Pit which would allow them to
initiatca operations as soon as any conditions placed upon the issuance of
the perriit are met. The only binding condition related to initiation of
operations at the Timnath Pit is a requirement for Kehn Construction to
install and monitor three stand-pipe piezometers intended to track
potenti~Ll impacts to sub-irrigated cropland to the west of the pit that
may be Affected by pit dewatering operations. If this condition is met,
Don Kehti Construction mat begin mining at any time.
2. Yo>3requested information regarding the approved reclamation plan for
the Timnath Pit. The Reclamation Permit for this site is an extensive
document: which, in total describes how the site will be mined and
reclaimed. The approved post-mining land use for the Timnath Pit is
recreation, with most of the site being reclaimed as wetlands and open
water ponds. The Reclamation Permit requires a phased approach to mining
and reclamation, with no more than 65 acres of the site affected by major
disturb~lnce at any given time during the life of the pit. The Mined Land
Reclamation Board holds a bond in the amount $192,222.50 for the Timnath
Pit as ~ISSUrance that the site will be reclaimed in accordance with the
permit ~lnd the performance standards of the Construction Material Rules
and Regulations. I have enclosed a copy of the Timnath Pit Reclamation
Plan Map showing proposed finished contours for the site upon completion.
YOl:I asked if the Division of Minerals and Geology would take any
