Box 459 <br />Florence, Colorado 81226 <br />Relinauishment Accepted <br />Period of Liability Under Lease Bond Terminated <br />Case File Closed <br />On July 23, 2002, Kerr Coal Company filed a letter of relinquishment for Federal coal lease C-22777 in <br />its entirety. <br />It has been determined by the Kremmling Field Office that the acceptance of this relinquishment will not <br />impair the public interest and all obligations of the lessee under the regulations and the terms of the lease <br />have been met. The 3 remaining drill holes are included in the State of Colorado hydrologic monitoring <br />plan for the site, and the State holds a bond for these 3 sites. The lease is in good standing with MMS <br />production and financial requirements. <br />Therefore, pursuant to the regulations found at 43 CFR 3452, the relinquishment is accepted effective <br />July 23, 2002, the date the relinquishment was filed. <br />The period of liability under coal lease bond no. 13-20-27 in the amount of $18,000 having Kerr Coal <br />Company as principal and National Union Fire Insurance Company of Pittsburgh, PA as surety, may be <br />terminated as of the date of this decision. <br />The case file shall be closed effective the date of this decision and our records noted accordingly. <br />/S/James E.
