We are in <br />receipt of your letter dated November 13, 1997 concerning Telluride Mining Company's <br />request for a Transfer of Permit and Succession of Operator for the C-JD5 Mine, Permit <br />No. M77248, from Blake Mining Company. The subject of your letter is Telluride Mining <br />Company's failure to address its inadequate financial warranty for the C-JD5 Mine. <br />According to a letter dated November 12, 1997 from Michael Long, the Division Director, <br />he indicates that Blake Mining Company is to attend a public hearing on December 17 and <br />18, 1997 to address the Board concerning a violation of a Colorado Mine Land <br />Reclamation Act. The purpose of this letter is to request a continuance of this issue until <br />the Board meeting on February 27 and 28, 1998. The reasons for this request for a <br />continuance are as follows. <br />It is our understanding from the Department of Energy that the Department has <br />given Telluride Mining Company until January 28, 1998 to have adequate bonding in place <br />and replace the bonds of Blake Mining Company. As a result of this deadline, it is <br />probable that Telluride Mining Company will not have the financial warranty issue resolved <br />until January 28, 1998. Consequently, this issue cannot be fully addressed until after the <br />Department of Energy deadline. <br />Secondly, I have contacted William Cohan, and he will be out of the country for the <br />January 1998 meeting. We feel that it is important for Mr. Cohan to be present during the <br />board meeting, and he will be in attendance for the February 1998 meeting. <br />Finally, Blake Mining Company needs this extension to resolve the financial <br />warranty issue with Telluride Mining Company and its lessor, Joe Baldwin.
