Alexander Pit - Acreaee release procedures <br />Dear Mr. Ballode: <br />The Division has reviewed your August 6, 2002 correspondence attached to your DMG Annual Report <br />wherein you indicated that you would like to have a portion of your approved permit area released from your <br />DMG permit. <br />Regardless of the settlement between Telluride Gravel and the Forest Service regarding reclamation of the <br />area in question, Telluride Gravel as the current DMG permit holder remains responsible for successful <br />completion of reclamation. In order to obtain release of this area from the DMG permit, the area must first <br />be completely and successfully reclaimed per the requirements of the Rules and the approved reclamation <br />plan. Secondly, Telluride Gravel must submit to the DMG a written request for release of reclamation <br />liability for the area in question, per the requirements of Rule 4.16 (see attached excerpt from the Rules). <br />Basically, the acreage release process is as follows: <br />1. Prepare a letter notifying DMG that all reclamation work has been completed for the area in question. <br />2. Include in the letter the names and addresses and phone numbers of all owners of record of the lands <br />requested to be released. <br />3. Include in the letter a statement signed by an authorized representative of Telluride Grave] that all <br />applicable portions of the Reclamation Plan requirements have been satisfied in accordance with <br />these Rules and all applicable requirements under the Act. <br />4. Send the letter to DMG by Certified Mail and keep it separate from all other types of communication <br />to the office. <br />To the extent the information provided to the DMG in the annual report and associated correspondence was <br />intended by Telluride Gravel to be a request for acreage release, the request is hereby denied as it does not <br />conform to the requirements of Rule 4.16. <br />
