Cattany <br />Division Director <br />Natural Resource Trustee <br />Re: Continuance of Formal Public Hearing, Appeal of Division Determination of Designated Mining r/ <br />Operation Status fort a Following Permitted Mines: M-1977-306, JD-9 Mine, M-1977-310, JD-6 Mine~M- <br />7978-116, SM-18 Mine, and M-1984-014, JD-8 Mine. <br />Dear Mr. Williams: <br />The Colorado Division of Minerals and Geology (DMG) has received Cotter's hydrological study and modeling <br />of the permitted areas in question. The Division has begun the review process and has some questions regarding <br />the modeling and study reports. Both the Division Staff and Cotter have agreed to a continuance of the scheduled <br />Board Hearing so that the questions and issues can be addressed in more detail. Should the issues be resolved, a <br />formal hearing may not be necessary if the Division agrees and accepts the modeling and study results. However, <br />if both parties disagree, the Board will hear the matter and make the final decision. <br />Therefore, staff has re-scheduled the matter for Formal Public Heazing before the Colorado Mined Land <br />Reclamation Board, for consideration. The hearing will be held in Room 318. 1313 Sherman Street. Del <br />at 10:00 a.m. or as soon thereafrer as <br />the matter can be considered.
