Sheridan mine
Dear Iv1r. Connor.
ST:1TE SERVICES BUILDING
I S25 Sherman Street - 5th Floor
Denver, Colorado 80203
Phone (303) 866-4500
FAX (303) 866-5691
On February 11, 2000, I contacted you by telephone concerning the Phil Sheridan mine
site for which Comstock Mining and Refining holds a permit issued by the Mined Land
Reclamation Board. During our conversation I informed you that the Division of Minerals and
Geology has a concern about whether Comstock Mining has the required legal right to enter and
mine the permitted area. From the Division's files, it appears that Comstock's legal right to enter
was based on a lease from landowners, HalTy and Astrid Covey. However, Mr. Covey appears
to have terminated the lease several years ago.
In our February I Ith conversation, you said that you are trying to negotiate a new
agreement with Mr. Covey and would contact him to facilitate such an agreement. On February
28 and March 7, I called you and lefr voicemails asking yotl to inform me of the status of any
agreement between Comstock and the Coveys. You have not returned my phone calls.
Please contact me immediately at (303) 866-5127 and inform me about Comstock's
ability to enter and mine the permitted area, including any agreement you have reached with the
Coveys. If I have not heard from you by Mazch 31, 2000, the Division will issue a notice of
violation stating that it has reason to believe Comstock is not in compliance with applicable
statutory, regulatory and permit conditions, and this matter will be set for hearing before the
Mined Land Reclamation Board for possible revocation of Comstock's permit and forfeiture of
its bond.
