Proposed Decision <br />INTRODUCTION <br />In accordance with Rule 3.03 of the Regulations of the Colorado Mined Land <br />Reclamation Board (MLRB) for Coal Mining, this document constitutes written <br />notification of the Division of Minerals and Geology's (Division) proposed decision to <br />approve a partial Phase I and a full Phase II and Phase III bond release (SL-05) for <br />30.6 acres of disturbed area, including all permanent structures, ditches, and the <br />single sediment pond, and about 117 acres of affected area within the permit area at <br />the Raton Creek Mine (permit #C-82-055) permitted by Energy Fuels Mining <br />Company. The permit area is 1,310 acres of which 30.6 acres were disturbed during <br />operations. The permit area is located within portions of: <br />SW1/4, Section 31, T33S R63W; <br />All of Section 36 except portions of W1/2 W1/2, T33S R64W; <br />All of Section 6, T34S R63W; <br />N1/2 NE1/4, NE1/4 NW1/4, Section 7, T34S R63W; <br />E1/2 E1/2, E1/2 SE1/4, Section 1, T34S R64W of the 6`h P.M. <br />The area is shown on the U.S.G.S Trinidad East, Colorado, 7.5 Minute Quad Map. <br />The area is generally located about one mile southeast of Exit 11 along Interstate 25 <br />south of Trinidad, Colorado in Las Animas County. The rationale for this approval is <br />outlined below. <br />The Raton Creek Mine is an underground mine which was permitted and operated by <br />Energy Fuels Mining Company. The ownership of the land surface and the minerals <br />for which bond release has been requested is private. Reclamation of the disturbed <br />land began in 1991 and permanent seeding was completed in 1995. The Phase I <br />portion of this bond release request applies to a number of structures and features <br />previously excluded from four, prior bond release applications (SL-01 to SL-04) for <br />which the Division issued a decision and completed a written finding. This bond <br />release (SL-05), if it becomes final, would terminate all jurisdiction of the Division and <br />the MLRB at the site. <br />Detailed information about the review process can be found in the Act and the <br />Regulations of the Colorado Mined Land Reclamation Board for Coal Mining.
