ni III IIIIIIIIIIIIIIII <br />Haul Road Maintenance <br />Could the Ghost of Coal View be in charge of this <br />ranch's coal haul and access roads? <br />Consider that Sun Coal has the exclusive right by Court <br />Order to maintain all access and haul roads. Did the Ghost <br />intervene when the Court stopped us from doing anything to <br />maintain the haul road to protect our livestock, wildlife <br />and humans? <br />Has Sun Coal maintained or how do you maintain a road <br />that was ripped up, ditches 1' deep, 15' wide installed <br />every 150' at various angles across it? In areas where <br />berms were removed, 6" high, 5' to 15' wide dirt shoulders <br />were installed. The haul road as now destroyed is dangerous <br />and must be traveled with caution, when it is usedl <br />Snow removal is impossible and has never been done by <br />Sun Coal. Others have placed snow against the berms or onto <br />the shoulders. This of course makes everyone of the 90 <br />ditches a mud hole in the spring. Vehicle tracks thru the <br />last to melt ditches cause most of the water to run down the <br />road instead of in the ditches. The ditches also take water <br />away from the road shoulder depleting the summer grazing <br />capacity. Soon the road is usable only by 4 x 4's, graders <br />and crawler tractors. This problem exists several months <br />each year. So far only a small section (21 ditches) of the <br />road has been used in winter, so what about the rest of the <br />road? In two areas the road slopes toward the outside berm <br />so badly that it's impossible to keep a vehicle in the road <br />after a rain or light wet snow. <br />The original road was used by Sun Coal and others for <br />over 6 years with no problems. The run-off did not kill any <br />cattle, wildlife, or endanger any humans close to the road. <br />The erosion off the haul road is still continuing, still <br />creating trenches and still filling our ponds. <br />We state, again, we will accept the road "as is" only if <br />satisfactory financial arrangements can be made to rebuild <br />the road as our attached profile proposes. <br />Sincerely, <br />Mr John Eilts ~~ <br />17 0 West US 40 <br />Steamboat Springs, CO 80487 <br />(303) 276-3573 <br />
