Long <br />Division Dnecror <br />Citizen <br />The Division received your letter of December 18, 1992 regarding <br />Basin Resources continued drilling operation past the specified <br />deadline of December 15, 1992 set forth in the Notice of Intent. <br />The letter was received in the office on December 21, 1992 and a <br />site inspection was conducted by the Division on December 22, 1992. <br />I spoke with Robin Byers of your firm to inform Richard Babnick of <br />Raton West that the inspection would be conducted on December 22, <br />1992. Ms. Byers stated that Richard Babnick was out of town for a <br />few days, and would not be able to attend the inspection. Under <br />the Colorado Rules and Regulations, Richard Babnick waived his <br />right to accompany the inspection. Mike Ossla of the Las Animas <br />County Planning and Land Use Office attended the inspection at the <br />request of Robin Byers. <br />I met Mike Ossla in Trinidad at 1:00 pm. Drill site NM-4 was <br />inspected, and there was no activity on site. The Division also <br />inspected the roads to determine if they were constructed according <br />to their permit. The NOI approved by the Division allows Basin <br />Resources to construct 100 linear feet of new road to access the <br />drill site. The Division found no evidence of road construction <br />beyond what was approved in the permit. <br />The inspection continued at the Basin Resources Office located in <br />the current Golden Eagle Mine. Ron Thompson was present at the <br />mine site. Mr. Thompson stated that drilling at site NM-4 <br />continued through the 15th, 16th,: and 17th of December and <br />reclamation of the hole ended on the 18th of December. Based upon <br />this information, the Division issued notice of violation X-92-O1 <br />(previously C-92-42) for failure to follow the NOI approved by the <br />Division. Please see the attached inspection report and the notice <br />of violation for clarification. <br />
