The DMG hereby finds that the Personal Injury and Property Damage Insurance <br />Information required by Rule 2.03.9 has been properly submitted, reviewed and deemed <br />adequate (2.G8.6(2)(b)(iii)). <br />7. The DMG hereby fmds that the Identification of Other Licenses and Permits required by <br />Rule 2.03.10 has been properly submitted, reviewed and deemed adequate <br />(2.08.6(2)(b)(iii)). <br />8. The DMG hereby finds that, based upon all available information, Central <br />Appalachia Mining, LLC, and all related owners and controllers of Central <br />Appalachia Mining, LLC, are currently in compliance with Rules 2.07.6(1)(b) and <br />2.07.6(1)(c). Applicant Violator System (AVS) evaluations conducted by the <br />DMG (most recently on November 16, 2004) confirm that the applicant is in <br />compliance with 2.07.6(1)(b) and 2.07.6(1)(c). <br />9. The DMG hereby finds that the succession application demonstrates compliance with <br />Rule 2.0?.6(2) (2.08.b(4)(a)). <br />10. The DMG hereby finds that, based upon representations made by the applicant, Central <br />Appalachia Mining, LLC will conduct the operations in full compliance with the terms <br />and conditions of the original permit and in accordance with the requirements of the Act <br />and Rules (2.08.6(4)(c)). <br />Decision <br />The DMG hereby approves the Request for Transfer of Coal Permit and Succession of Operators <br />for Permit No. C-1980-004, from Lodestar Energy, Inc., to Central Appalachia Mining, LLC. <br />Stipulations previously attached to Permit No. C-1980-004 remain in effect. There are no <br />additional stipulations imposed as a result of the permit transfer. <br />Any person with an interest, which is or may be adversely affected by this decision, may request <br />a formal hearing on the decision by the DMG. Such requests shall be in writing and state with <br />reasonable specificity the reasons for the request and objections to the decision. If so requested, <br />the formal hearing shall be conducted in accordance with the requirements of 2.07.4(3). The <br />request for hearing must be received no later than 30 days after the requesting party's receipt of <br />this decision. Such requests shall be sent to the Colorado Decision of Minerals and Geology, <br />1313 Sherman Street, Room 215, Denver, Colorado 80203. <br />
