No significant mine inflows have been encountered at the Bear No. 1, 2, and 3 Mines. No discharges of mine inflow water have taken place. Bear Coal Company uses water from the North Fork of the Gunnison River for dust suppression within the mine. Surface Water - Surface water information for the Bear No. 1, 2 and 3 Mines is presented in Sections 2.04.7 and 2.05.3 of the Bear No. 1 and 2 permit application, and in Section 2.04.7, 2.05.3 and 4.05 and Map 10 (Mine Facilities) of the Bear No. 3 permit revision application. Surface rua~ff from the undisturbed portions of the Bear permit area flows directly into the North Fork of the Gunnison River through four small intermittent drainages. The North Fork of the Gunnison is the primary stream in the drainage basin (Figure 5). No surface discharge of mine water is expected from the Bear No. 3 Mine. No. surface discharge from the Bear No. 1 and 2 portals occurred while they were in operation, and no discharge from the abandoned Edwards portal has been recorded. Surface run-off from the disturbed auras of the Bear Mine is collected by a series of drainage ditches and directed into sedimentation ponds. Effluent from the sedimentation ponds is controlled to meet NPDF.S effluent standards. Bear Coal Company has had problems with the North Fork of the Gunnison River flooding • the facilities aura at the Bear No. 3 Mine. Flooding problems may have been aggravated by relocation of the river associated with relocation of state Highway 133. Bear Coal Company has installed a flood control berm adjacent to the North Fork of the Gunnison River to control flooding of the facilities area and to mitigate off-site disturbances related to mining. Water rights and replacement information for the Bear No. 3 Mine is presented in Sections 2.04.7 and 4.05.15 of the Bear No. 3 permit revision application. Water used at the Bear No. 3 Mine is derived from two sources. Potable water consumed at the site is provided by the Somerset Domestic Waterworks. Water withdrawn from the North Fork of the Gunnison River is used in the mine for dust suppression and other mine-related uses. The Bear operation annually consumes approximately two acre-feet of water for mine-related activities. Bear Coal has a water right allowing for annual withdrawal of up to seven acre-feet of water from the river. No ground water is taken from aquifers by the Bear Coal Co. mining operation; therefore, • the Bear operation will not adversely affect any ground water rights. The small amount of water withdrawn from the North Fork of the Gunnison River should not affect the water rights of other downstream users. 9
