there are several landslide features above the proposed underground workings and Oxbow <br />Mining, LLC committed to monitor these features. To date, no impacts have been noted. <br />The applicant conducted a subsidence monitoring program during the period the Sanborn <br />Creek Mine has been active, in accordance with Rule 2.05.6(6)(c), designed to determine <br />the commencement and magnitude of subsidence movements. The results of the <br />monitoring program were submitted to the Division annually. The monitoring program <br />was designed to extend for a time, beyond cessation of mining in any area, consistent <br />with the need for verification of the subsidence prediction. <br />For the Elk Creek Mine, the applicant conducted an inventory of "all structures and <br />renewable resource lands which exist within the proposed permit and adjacent area" as <br />required by Rule 2.05.6(6)(a). The determination was that no such structures or features <br />exist within the area to be undermined by the Elk Creek activity. Therefore, no further <br />action was required. The operator, though, submitted a subsidence evaluation for the <br />area, which can be found in Volume 12 of the permit, Exhibit 2.05-E8. <br />In response to a stipulation on the federal coal lease, the operator will conduct a detailed <br />survey in two parts -the spring and fall of 2003 - for previously unidentified water <br />resources. If any such resources are identified and could be impacted by subsidence, the <br />operator will submit a plan for replacement to the US Bureau of Land Management <br />and/or the US Forest Service. <br />XI. Operations on Alluvial Valley Floors <br />The Division has determined that an alluvial valley floor exists in an adjacent azea. <br />Therefore, the following findings aze in order for the alluvial valley floor that is <br />located on the North Fork of the Gunnison River downstream from the mine site. <br />The Division finds that activities proposed by the applicant will not interrupt, <br />discontinue, or preclude farming on the alluvial valley floors that are irrigated or <br />naturally subirrigated (4.24.3(1)). <br />The proposed activities will not materially damage the quantity or quality of water in <br />the surface or ground water system described above (4.24.3(3) and 2.06.8(5)(a)(ii)). <br />Coal mining and reclamation operations will be conducted to preserve the essential <br />hydrologic functions of alluvial valley floors outside the permit area throughout the <br />mining and reclamation process (4.24.2). <br />c:Uns97~sanborn~RN03 Sanborn Findings.doc <br />28 <br />
