Section B <br />The following findings and specific approvals are required by Rule 4: <br />Roads -Rule 4.03 <br />A. Haul Roads <br />Information pertaining to roads can be found on pages 2.05-SR and 2.05-9, and <br />Maps 5 and 9. The hauUaccess road at the loadout connects the facilities with <br />State Highway 133. Road cross-sections and profile drawings aze presented on <br />Map 9. The location of road drainage ditches and culverts is provided on Map <br />14. <br />2. The Division proposes to approve the retention of a portion of the haul road <br />which leads to the office azea (depicted on Map 10) because the road is <br />compatible with the approved post-mining land use, and a request for its <br />retention was submitted by the landowner. The office and garage will remain <br />after the loadout has been reclaimed and will be converted to a residence and <br />garage following reclamation. Therefore, retention of the road is required to <br />provide access. Iu addition, this roadway will provide access for two adjacent <br />landowners since Delta County is planning to abandon County Road 4365. The <br />roadway is approximately 400 feet long and 24 feet wide. <br />3. The lower portion of the haul road which enters the coal loadout pad will be <br />reclaimed following cessation of mining activities. <br />4. Terror Creek has obtained a Permit for Access from the State Highway <br />Department for the highway approach and a License Agreement with the Bureau <br />of Reclamation and the Fire Mountain Canal Company to allow construction of <br />a concrete box culvert across the Fire Mountain Canal (4.03.1(1)(f)(i)). <br />B. Access Roads <br />The Division proposes to approve the retention of the graveled access road <br />which leads to the office azea because it is compatible with the approved post- <br />miningland use, as stated above in the haul road section, and because a request <br />for its retention was submitted by the landowner. <br />C. Light-Use Roads <br />The Tenor Creek Loadout maintains two light-use roads. One road parts from <br />County Road 4365 and enters the permit azea from the east side, below the <br />storage azea, and ends at the water tank. <br />11 <br />
