Baillie, President of Harrison Western <br />Corporation, in which you allege that a culvert <br />installed by Harrison Western "trespasses onto the <br />leasehold area of Enerqy Fuels," and, therefore, should <br />be "removed immediately." <br />As you may know, Harrison Western performed the <br />work in question at the express direction of, and to <br />fulfill a specific requirement imposed by, the Mined <br />Land Reclamation Division. Therefore, Harrison Western <br />is not at liberty to remove the culvert as you request. <br />It has, however, spoken with the Division about this <br />matter, and was advised that the Division has spoken <br />with you and has determined that removal of the culvert <br />is unwarranted. From Harrison Western's standpoint, the <br />Division would be responsible for, and bear the cost of, <br />removing the culvert, and such action would be <br />appropriate only if it did not increase Harrison <br />Western's reclamation obligations in any way. <br />Your most recent letter, when coupled with some <br />of your prior correspondence, suggests that you are <br />attempting to harass Harrison western and the Division, <br />perhaps because of continued displeasure over the <br />compliance agreement.
