A copy of my findings are attached for
your review.
I am recommending that the State not make any more payments against this
project. I am also recommending that notice be given to complete the work to the
State's satisfaction in accordance with the contract documents. This notice should
establish a set time for completion at which time the State should terminate the
contract and take over the work to be completed with the costs to be deducted
from the funds currently available. If those funds are not sufficient to complete the
work the State can, at their option, pursue relief through the appropriate bonds.
This recommendation is based on my findings that the monies currently available
under this contract are insufficient for satisfactory completion in the event of
contract default. Please see the attached "Financial Summary of Claim". Please
note that the monies, which the State concurs in against each claim (Col. C, line
49) are less than what is estimated to complete the project (Col. B, line 781. The
difference is summarized on under the SUMMARY report (Col. B, lines 83-861.
The monies, which the State concurs in, are a result of my review of your claim
dated December 23, 1994 to Mr. Andre' Pettigrew. A copy of my comments are
attached for your review. These findings were established using an independent
review from the data that was provided to me, which was then compared against
the findings issued by Sandra Brown on December 13, 1994. If I found that her
findings were more favorable to the contractor, I made some adjustments to reflect
that. The area that we differ widely is my opinion of resolution.
Partners Providing Quality Service far Better Government
