<br />-8- <br />The applicant states on page 27 that "material below the crushed rock", <br />i which presently exists on the surface, "will be used to cover the rock <br />f and coal material with a minimum of 2 feet of non-toxic material" for use <br />1 as a plant growth medium. The application does not contain documentation <br />I that sufficient suitable soil exists on-site to provide for a 2 foot <br />i layer of non-toxic plant growth material. The following stipulation is <br />required: <br />Stipulation No. 2 <br />WITHIN THREE MONTHS OF APPLICATION APPROVAL, THE PERMITTEE MUST <br />SUBMIT THE RESULTS OF TEST CORINGS AND ANALYSES WHICH DOCUMENT THAT <br />SUFFICIENT SUITABLE PLANT GROWTH MATERIAL IS AVAILABLE. ANALYSES <br />SHALL INCLUDE TEXTURE, EC, pH, AND SAR. IF THE TESTS INDICATE THAT <br />SUFFICIENT MATERIAL OF ACCEPTABLE QUALITY IS NOT AVAILABLE, AN <br />ACCEPTABLE ALTERNATIVE WILL BE IDENTIFIED. <br />! With the acceptance of the above stipulation, the application is in <br />compliance with the requirements of this section. <br />IX. Bond - Rules 2.02.4(5) and 3.05 <br />The Division has reviewed the bond calculation submitted by the applicant <br />in Attachment A and performed an independent evaluation of the <br />reclamation costs that would be incurred by the State of Colorado, were <br />the state required to perform the reclamation. <br />The applicant proposed a bond amount of $4,800 which the Division finds <br />to be insufficient. <br />The bond amount calculated by the Division is $10,000. The bond in this <br />amount must be provided to the Division prior to initiating exploration. <br />lJith the submittal and acceptance of the bond the proposed operation will <br />be in compliance with the requirements of this section. <br />/ep <br />Doc.
