When I re-looked at the data to answer your <br />question about the road maintenance, I noticed that I had mis-typed the quarter section info. The correct answer is the DOW <br />owns land in the NE '/. of section of 22. DOW does NOT own the surface in the NW '/. of section 22. I do not have any <br />information on the owner of the surface in the NW Y.. You would have to have someone visit the La Plata county court <br />house and review the current plat and ownership records. DOW does own anon-exclusive use right of way that connects to <br />US 160 and goes on to the lands we do own and to the leased lands in section 16. <br />The county does not maintain the road, DOW and the other users do. <br />Sorry for the error and mis-information. The specific disturbed area that we spoke of is labeled "II" on this map, and is located in the <br />nw 1!4 of the nw 1/4 of Section 22, T35N, R10W, NMPM. <br />The road that I mentioned to you today comes off of Colo State Highway 160 in the sw 1/4 of the nw <br />1/4 of Sec 22, T35N, R10W, NMPM, and appears to be a southern access route for the Perins Peak <br />State Wildlife Area. While we have not yet formally begun the process of terminating our jurisdiction <br />at this mine site, we would like to know whether DOW is a surface or mineral owner of the land upon <br />which this road exists, as we may need to inform DOW at some point in the future if we in fact do <br />begin the process. <br />It would also be helpful to know whether it is DOW's responsibility to maintain this road.
