As <br />far as I know, the sediment pond at King Coal serves the purpose <br />intended as well as the pond at Blue Flame. My concern was not <br />whether King Coal's pond was in technical violation of the design <br />standards, but whether a different standard may exist[ <br />To have two ponds so close together, it appeared unusual to <br />require a strict compliance with the regulations for one and not <br />the other. If the only time ponds are reviewed by your office is <br />when some change or reconstruction is done, that explains why Blue <br />Flame's pond was not cited during all the years it was in place <br />prior to the recent work, as well as why other existing ponds may <br />not meet the technical specifications. <br />I do not know if other ponds are similarly built but I suspect <br />they are, based on your policy of waiting for someone to request an <br />inspection under section 5.02.5. However, the purpose of Mr. <br />Allen's comparing the King Coal pond and Blue Flame was to confirm <br />further that the ponds, as built, would serve the purposes <br />intended. There is no doubt that the design criteria of the <br />regulations when followed to the letter would insure a structure <br />that worked to collect water and avoid sediment flowing from the <br />site. It is also apparent that other design standards will achieve <br />the same purpose as Mr. Allen has stated. <br />
