(San Juan), specifically the portion ofthe Herbert Placer not leased to Gold
King and the access road area on the Black Cat owned by Salem Mncrals that are not
part of San Iuan's lease w Gold King. Also in this area is BI.1v1 land now claimed by San
Juan througft the unpatented Bridge claim deeded by SGC to San Juan. SGC would like
to apply to the Mined Land Reclamation Division (NERD} for release and removal of
this azea from SGC's permit to avoid any conflict that may arise should future
development or arcs disturbance be contemplated by San Juan.
SGC believes these lands currently meet the post mining land use and the approved
reclamation plan in the permit and had not planned any Curther work other than
monitoring of the sites to determine the appropriate time (dictated by vegetation
standards and SGC's continuing presence) to request inspection for release. Since SGC
no longer has a presence on these lands related to mine operations, the vegetation is
improving annually and San Juan tnay have plans that would conflict with SGC's permit
requirements, this may be the appropriate time to request release.
SGC would not have any objection or oppose any future development proposed for this
area providing there was no conflict with permit requirements imposed on SGC by virtue
of the area being within the American Tunnel permit area. Currently any disturbance or
site construction could technically be in conflict with SGC's permit. If you are in
agreement with the above and the removal of the azeas controlled by San Juan and Salem
