Long
Divmon Dveaor
The Governors Office has forwarded to me your letters of April 20
and May 7, 1993. As you have indicated, Abraxus Company has been
issued a Coal Mining and Reclamation permit by the State of
Colorado. This permit allows the permittee to extract 200,000
tons of coal per year.
The Colorado Surface Coal Mining Reclamation Act and the Colorado
Rules for Coal Mining require that an operator be in compliance
with applicable local laws. For most coal mining situations,
this usually means that the operator must comply with county land
use regulations and zoning requirements. The specifics of these
local requirements vary from county to county.
Once the county permitting issues are resolved, production at the
mine may commence. My review of the issues which you have raised
leads me to believe that these are local land use issues which
are normally resolved at the county level. This Division is not
in a position to influence local land use practices or
regulations. However, I will forward your letters to the
Department of Local Affairs. At the least, they may be able to
explain the county process to you in a more detailed manner.
Please contact me if you have questions or comments regarding the
Coal Mining and Reclamation permit.
Sincerely,
Steven G. Renner
Coal Program Supervisor
CC: Michael Long, Director
