Shores, Amendment to Pemrit No: M-199$-0.19; and a1T Subsequent Revisions <br />Gentlemen: <br />Hall-lrwin has demanded that we advise your office'of a technical correction to our letter dated June 12, <br />2003. Please be advised that <br />Pazagraph 4, page two should read as follows: <br />"Buyer shall obtain the written approval of such mining plan from the Seller, which approvals <br />Seller shall not unreasonably withheld. Seller's approval or disapproval. of the mining plan <br />shall be based on the criterion set forth above and once approved. Seller shall not further <br />challenge the minin¢ elan " <br />The substantive requirements of this section do not change in that Hall-Irwin must obtain BLC <br />Development's written approval of any Mitring- Plan. Of course, Hall-hwin did not advise BLC <br />Development that it was amending the Mitring Plan and certainly did not obtain its written approval. <br />Hall-Irwin also suggests that it has acknowledgements of receipt of certified mail from BLC <br />Development, LLC; however, Hall-Irvin has failed to provide copies. To our knowledge, we <br />receivediito such notice and our revie'iv of the files`of the Division of Mining and Geology did rut <br />reveal such certificates. BLC Development cannot state with certainty that notices were not dP~~ 1 <br />to"its offices; buf BLC Development is very skepfical of Hall-Irwin's statements.
