BLM modifies right-of-way approval, as appropriate. <br />Under ideal circumstances, the concerns identified by one agency will be <br />recognized by the other and solutions acceptable to both will be readily <br />achieved. In situations where this is not the case at first, efforts <br />necessary to reach a mutually acceptable position will be undertaken. if at <br />all possible, the awkward situation of MLR approving a revision containing <br />conditions unacceptable to the BLM will be avoided. <br />It should be noted that the above procedure inay appear to entail a <br />bureaucratic bypass, since the cooperative agreement dictates that the OSM <br />coordinate application review by Federal agencies. However, in this instance, <br />though both MLR and BLM are reviewing the same application, BLM's concern is <br />with how the revision affects the Right-of-Way Grant, not the SMCRA permit. <br />Increased communication between the two agencies will, hopefully, reduce <br />misunderstandings and insure that the interests of both the BLM and MLR are <br />addressed. To this end, copies of MLR inspection reports will henceforth be <br />sent to the Meeker BLM office and periodic joint inspections of those portions <br />of the permit area outside of the Federal lease will be considered. <br />/int <br />Doc.
