III IIIIIIIIIIIII III ~ ~ <br />Preliminary Chronology of Events <br />B&B Excavating, Inc. <br />Spill of Weed Killer - 1998 <br />July 1998 <br />Reportedly, two or three 55 gallon barrels of "Repco Kill II" were mixed into <br />a pile of '/< inch road base at the Montgomery pit, Eagle, Colorado. This weed <br />killer contains 90% #2 diesel and 2% 2,4-D. The '/. inch material was then <br />screened into''/z road base and'/, rock. <br />November b, 1998 <br />A B8~6 Supervisor reports at the end of the day to Scott Hoover, General <br />Manager, that weed killer may have been mixed on the road base material <br />used that day for making asphalt. Asphalt crew workers note weed killer smell <br />coming from the asphalt. <br />November 7, 1998 <br />B&B begins an investigation into the incident. The B&B Montgomery Pit <br />Asphalt Plant is closed down and the pile of suspected road base is cordoned <br />off. Hoover does emergency notifications to the National Response Center, the <br />Colorado emergency response center, and the Eagle County Emergency <br />response coordinator. We were unable to contact anyone at The Colorado <br />Department of Health, Air Quality Division. <br />November 9, 1998 <br />B&B contacts the Colorado Department of Health, Air Quality Division. <br />B&B begins a full scale investigation of the incident through legal counsel. <br />Employees with knowledge of the spill incident and those at the asphalt plant <br />are interviewed. The firm of Dames and Moore is hired to determine it the spill in <br />any way dangers the health and safety of the workers, the public or the <br />environment. to conduct an environmental assessment of the incident, and to <br />prepare a remedial plan to address any and all required clean up issues. <br />November 10, 1998 <br />B8.B continues its investigation. Extensive discussions with Dames and <br />Moore and its toxicologist regarding any potential health risks. All B&B <br />employees that worked near the asphalt in question are contacted for health <br />information. <br />
