-3- The Division finds that the operations proposed under this revision application have been 'designed to prevent damage to the hydrologic balance outside the permit area (Rule 2.07.6(2)(c)). 4. The proposed area of the permit revision is not within an area designated unsuitable for surface coal mining operations, or within an area under study for designation as unsuitable for surface coal mining operations. The proposed area is not on any lands subject to prohibitions or limitations, within 100 feet of the right-of-way of a public road, or within 300 feet of an occupied dwelling (Rule 2.07.6(2)(d)). 5. The proposed operations will not affect any publicly owned park or place listed on the National Register of Historic Places (Rule 2.07.6(2)(e)). 6. The private surface estate has not been severed from the mineral estate in any of the areas to be mined. Therefore, the documentation specified in Rule 2.03.6(2) is not required (Rule 2.07.6(2)(f)). 7. No surface mining operation owned or controlled by trhe applicant is currently in violation of the Act or any applicable law of the United States or Colorado (Rule 2.07.6(2)(8)). 8. The applicant does not control and has not controlled mining operations with a demonstrated pattern of willful violations of the Act of such nature, duration, and with such resulting irreparable damage to the environment as to indicate an intent not to comply with the provisions of the Act (Rule 2.U7.6(2)(h)). 9. Surface coal mininy reclamation operations will be performed under this permit revision so as not to be inconsistent with any other such operations anticipated to be performed in areas adjacent to the permit area (Rule 2.U7.6(2)(i)). 10. No additional bond is required for the permit revision due to the fact that the revision entails only underground activities (Rule 2..U7.6(2)(j))• 11. The applicant has submitted sufficient information in both the permit application and pernit revision application in order for the Division to make a negative determination as to the existence of prime farmlands and alluvial valley floors within the affected area of this approval (Rule 2.07.6(2)(k)). 12. The proposed post-mining land use of the permitted area as revised continues to be highland agriculture, which is largely rangeland. This land use has been approved by the Uivision (Rule 2.01.6(2)(1)).
