-3- <br />The Division finds that the operations proposed under this revision <br />application have been 'designed to prevent damage to the hydrologic <br />balance outside the permit area (Rule 2.07.6(2)(c)). <br />4. The proposed area of the permit revision is not within an area <br />designated unsuitable for surface coal mining operations, or within an <br />area under study for designation as unsuitable for surface coal mining <br />operations. The proposed area is not on any lands subject to <br />prohibitions or limitations, within 100 feet of the right-of-way of a <br />public road, or within 300 feet of an occupied dwelling (Rule <br />2.07.6(2)(d)). <br />5. The proposed operations will not affect any publicly owned park or <br />place listed on the National Register of Historic Places (Rule <br />2.07.6(2)(e)). <br />6. The private surface estate has not been severed from the mineral <br />estate in any of the areas to be mined. Therefore, the documentation <br />specified in Rule 2.03.6(2) is not required (Rule 2.07.6(2)(f)). <br />7. No surface mining operation owned or controlled by trhe applicant <br />is currently in violation of the Act or any applicable law of the United <br />States or Colorado (Rule 2.07.6(2)(8)). <br />8. The applicant does not control and has not controlled mining <br />operations with a demonstrated pattern of willful violations of the Act <br />of such nature, duration, and with such resulting irreparable damage to <br />the environment as to indicate an intent not to comply with the <br />provisions of the Act (Rule 2.U7.6(2)(h)). <br />9. Surface coal mininy reclamation operations will be performed under <br />this permit revision so as not to be inconsistent with any other such <br />operations anticipated to be performed in areas adjacent to the permit <br />area (Rule 2.U7.6(2)(i)). <br />10. No additional bond is required for the permit revision due to the <br />fact that the revision entails only underground activities (Rule <br />2..U7.6(2)(j))• <br />11. The applicant has submitted sufficient information in both the <br />permit application and pernit revision application in order for the <br />Division to make a negative determination as to the existence of prime <br />farmlands and alluvial valley floors within the affected area of this <br />approval (Rule 2.07.6(2)(k)). <br />12. The proposed post-mining land use of the permitted area as revised <br />continues to be highland agriculture, which is largely rangeland. This <br />land use has been approved by the Uivision (Rule 2.01.6(2)(1)). <br /> <br />
