Findings of the <br />Colorado Mined Land Reclamation Division <br />for <br />The Animas Mine <br />Explanation of Findings <br />Pursuant to Rule 2.07.6(2) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining, the Mined Land Reclamation Division, <br />or the Board, must make a.number of written findings prior to the <br />approval of a permit revision. These findings are based on information <br />made available to the Division that demonstrates that the applicant will <br />be able to operate in compliance with the Colorado Surface Coal Mining <br />Reclamation Act and the regulations promulgated pursuant to the Act. <br />This permit revision entails an increase in the extent of underground <br />workings at the Animas Mine. No additional surface disturbance is <br />proposed. This Findings Document is, therefore, an amendment to the <br />findings that were issued prior to approval of Permit No. C-U55-82. for <br />the most part, these findings merely reaffirm those made previously. The <br />finding required by Rule 2.07.6(2)(c) concerning hydrologic impacts has <br />been expanded i.n this document. <br />This Findings Document is organized according to Rule 2.07.6(2), items <br />(a) through (o). <br />1. The permit revision application is accurate and complete and <br />complies with all requirements of the Act and the Regulations (Rule <br />2.07.6(2)(a)). <br />2. The applicant has demonstrated that surface coal mining and <br />reclamation operations, as required by the Act and these rules, can be <br />feasibly accomplished under the mining and reclamation operations plan <br />contained in the permit revision application (Rule 2.U7.6(2)(b)). <br />3a. Probable Hydrologic Consequences <br />The applicant has provided an additional statement of probable <br />hydrologic consequences for the operations covered by the permit <br />revision, beginning in Section 2.06.5. This is in addition to the <br />information submitted in the permit application for mining and <br />reclamation permit No. C-055-82. These findings shall, therefore, be <br />considered an amendment to the findings concerning probable hydrologic <br />consequences that were written prior to issuance of Permit No. C-055-82. <br />The operations could impact the hydrologic system through 1) <br />impacts to surface water quantity and quality as a result of subsidence, <br />2) impacts to ground water quality through mine water inflows. In both <br />cases, the Division has determined that the probable hydrologic <br />consequences will be minimal. <br />+ vt~.. ~ _~ .. x_. <br />
