<br />Mr. Richard Raines <br />August 30, 2000 <br /> <br />Page 2 <br />This substitute water supply plan renewal is hereby approved pursuant to Section 37- <br />80-120, C.R.S., subject to the following conditions: <br />Monthly accounting of water in this plan, including evaporation, dust suppression, <br />amounts of water removed via product, stream depletions, and replacement water <br />deliveries must be provided to the Water Commissioner and Division Engineer by the <br />10`h of the following month on forms and at times acceptable to them. The name, <br />phone number, and mailing address of the contact person who is responsible for <br />operation of this plan must be provided on the accounting forms. <br />2. The water leased by the applicant shall be released at the discretion of the Division <br />Engineer and the Water Commissioner. <br />3. The total water consumed by LaFarge must not exceed 20 acre-feet per year. <br />Records of water usage must be maintained to the satisfaction of the Water <br />Commissioner. <br />4. At such time as the stream is returned to its original channel, the surface area of the <br />stream must not have been increased. <br />5. In accordance with amendments to Section 25-8-202(7), C.R.S., and "Senate Bill 89- <br />181 Rules and Regulations" adopted on February 4, 1992, the state Engineer shall <br />determine whether or not the substitute supply is of a quality to meet requirements of <br />use to senior appropriators. As such, water quality data or analysis may be <br />requested at any time to determine if the water quality is appropriate for downstream <br />water users. <br />6. This substitute water supply plan may be revoked or modified at any time should it be <br />determined that injury to other vested water rights has or will occur as a result of the <br />operation of this plan. <br />7. The plan shall be valid through December 31, 2002, unless otherwise revoked or <br />modified. <br />8. Should this substitute water supply plan expire without renewal or be revoked prior to <br />adjudication of a permanent plan for augmentation, all uses of water must cease <br />immediately. <br />9. Should a request for renewal of this plan be needed, such renewal request must be <br />submitted to this office at least 45 days prior to the expiration date of this plan <br />(November 16, 2002). <br />10. Acceptance of these conditions will be assumed unless a response to the contrary is <br />received by this office, the Division Engineer at 310 E Abriendo, Ste B, Pueblo, CO <br />81004, and the Water Commissioner, Mr. Charlie Judge at P.O. Box 100, Wetmore, <br />CO 81253, phone #(719) 784-3172. <br />
