C C„ <br />We have the following comments about Mr. Ranney's reply to our first <br />comments about the East Pit plan. <br />Perhaps as an aide to us, you could demonstrate on the cross section <br />EE', the perspective map, and the topo map the 35 foot cut of the top of <br />Chen's hill, please. <br />We have tried to show that your cost estimates are inaccurate in at <br />least two areas. A check with the Caterpillar dealer indicates that it <br />would cost $5500 per each D10 to move in and out of the job from Denver. <br />Your estimate is about $1000 per machine or approximately $18,000 too <br />low. Your estimate for seeding is about $400 per acre less than what <br />your Division requires for bonding estimates for seeding or <br />approximately $30,000 too low. Is your approach to cost estimating the <br />reason than the Harrison Western final payment of $18,500 is <br />approximately $14,500 too low? We understand that the low bid will be <br />the determing cost, but grossly under estimating the cost of the <br />proposed work will result in the same problems as the West Pit: too <br />little money for too much work. The two concerns mentioned above show <br />the realistic cost to be about $48,000 more than the available bond <br />money. <br />With regard to diversion ditches, Mr. Berry of your Division stated that <br />permanent diversion ditches should be sized for a 100 year 24 hour <br />event, yet some are to be only sized for a 25 year event. <br />It would seem more scientific to measure the volume of the topsoil piles <br />instead of assuming their volumes to equal the volume required to cover <br />76 acres with 0.5 feet. The question: "Is it a good practice to rob an <br />undisturbed area [for topsoil]?" has not been answered. <br />The road plans have not been clarified. Mr. Acre of Energy Fuels has <br />stated that the landowner from Sec. 31 may not pass through the <br />Southfield Mine area. It is possible that you might receive access over <br />the old access road, but it is over land that we do not own. We would <br />readily allow the closure of the present road if you can provide us with <br />an easement for the old road and if Energy Fuels agrees to the closure <br />of what now is their permitted road. <br />Sincerely, <br />~C/ <br />W.D.
