on March 9, 1989. A Phase II bond release of $144,585.00 was granted on October 27, <br />1995, for the portion of the pit area owned by Grassy Creek Coal Company. The <br />remaining liability after those releases was $204,192.00, of which $159,803.00 applied to <br />the pit area and ponds, and $44,389 to the loadout area (facilities, foundations, gravel, <br />Yampa sediment pond). Approval of this release would lower the liability to $159,803.00, <br />all of which applies to the pit area and sediment ponds. A detailed summary of <br />performance bond liability and release amounts follows in Table 1 of this document. <br />The Division currently holds a performance bond of $348,777.00. The current <br />reclamation liability at the site is $204,192.00. Based on the observations above, the <br />Division proposes to release $44,389.00 <br />The remaining $159,803.00 is sufficient to assure completion of the remaining reclamation <br />work at the site if the work had to be performed by the Division, including the cost of <br />reestablishing vegetation on any revegetated areas, should revegetation in those areas fail, <br />and redistributing topsoil on the portion of the pit owned by the Ei]tses. The Division <br />estimates its cost to complete remaining reclamation work at the site to be $159,803.00. <br />Reclamation work which remains to be done at the site includes: <br />1. Removal of three sedimentation ponds (Upper (No. 2) and Lower (No. 1) <br />Pit Area, and Explosives Storage Area). <br />2. Removal of diversion and collection ditches in the pit area. <br />Any person with a valid legal interest which might be adversely affected by this proposed <br />decision may request a formal public hearing before the Mined Land Reclamation Board <br />in accordance with Rule 3.03.2(6). Public notice of this proposed decision will be <br />published twice in the Steamboat Pilot as soon as possible. Requests for public hearing <br />must be submitted to the Division in writing within thirty days of the first publication in <br />the Steamboat Pilot.
