_lp_ The pre~nining land use classifications on the area are: 1) grazing land for domestic livestock and wildlife; 2) orchard land in the area of the loadout facilities; and 3) previous mine disturbances. After mining, Colorado Westmoreland Inc, plans to return the land to the preanining land uses of grazing for livestock and wildlife for the mine site and orchard land for the loadout facilities. The permit renewal will not change the previously approved post mining land uses. The Division hereby approves the postanining land uses of the proposed operation. It was determined that grazing for both livestock and wildlife for the bench areas and orchard use for the storage silos, truck dump, train loadout areas, and the railroad spur meets the requirements of Rule 4.16 and 2.07.6(2)(1 ). - -- The proposed operation is in canplfance with the requirements of this section. III. CULTURAL AND HISTORIC RESOURCES (2.04.4, 2.05.6(4)) Cultural, historic and archaeological resource surveys were conducted over the proposed life of mine and adjacent areas. The methodology and results of these surveys are set forth 1n detail 1n the Archaeological Appendix in Volume 9B. The State Historical Preservation Officer reviewed the 1983 • application/permit revision and the 1986 permit revision and has determined that there are no sites within the permit area currently listed in the National Register of Historic Places. Subsequently, and in accordance with 2.07,6 (2 )(e ), the Oirision finds that the proposed mining operation will not adversely affect arty publicly owned park or place listed on the National Register of Historic Places. Additionally, although not required by Colorado regulations, within the Federal Regulations, there is a further consideration of °cultural and historic resources eligible for listing on the National Register of Historic Places:. Surveys classified seven of these sites as eligible for the National Register, pending further investigation. None of the seven are going to be disturbed by development activities, and none will be undermined. The Roatcap Game Trail Site (5DT 271) was excavated in late 1986 to ensure that Increased access in the East Roatcap drainage would not result in vandalism. Several of the other sites have a very limited potential for subsidence damage, as they are found on the margins of the angle of draw. The Division finds tfie operation in compliance with the requirements of this section.
