Other Activities. As a result of ongoing monitoring of the Nucla Mine site, remedial
actions may become net essary. These could include, but not be limited to, 1)
interseeding previously reclaimed areas; 2) weed control; and 3) repairing rills and
1 gullies. Any such activities will be conducted in conformance with The approved PAP.
Of particular note, [he Colorado Inactive Nine Reclamation Program is planning on
conducting some remedial reclamation on some areas of old spoils at Nucla Mine on which
Peabody has no rec tamation liability. Peabody will continue to work with both the IML
' and CMLRD staffs to coordinate and accomplish this mast beneficial work.
' Rule 4.30.1(2)(d) - Reason for Temoora ry Cessation
The Nucla Generating Station, formerly operated by Colorado ute Electric Association
(Ute), was [he sole customer for coal from the Nucla Mine. The coal supply agreement
under which the mine reopened in 1987 expired in June, 1999. Subsequently, final
backfilling and grading was completed in Area 7 as of January 1992. Because of the
proximity of Nucla Mine to the generating station, and because of the amount of coal
' station will require during the operating phases of the fluidized bed combustion boiler,
Peabody continues to be in a strong marketing position to supply at feast a portion of
the coal needs of the Nucla Gener acing Station. Such marketing activities are ongoing
and will continue in order to again reactivate Nucla Mine.

' 4
