After some discussion <br />it was agreed that Dorchester would submit a letter describing <br />the nature of the problem and the measures we are taking to <br />alleviate the situation. Before getting into the issue I would <br />like to assure you that it is Dorchester's policy to be candid, <br />straight-forward and cooperative with your agency regarding <br />any and all issues surrounding our operations. To this end I <br />have initiated at least two meetings with the C~fLR staff, along <br />with telephone calls too numerous to mention, in which I have <br />discussed my understanding of the history of the problem, the nature <br />of the problem and various solutions which have been considered by <br />Dorchester. I have sincerely appreciated the suggestions and <br />generally positive cooperation demonstrated by the CMLR staff to <br />date. <br />As I understand the situation, in the fall of 1981 the preparation <br />plant began producing an unaticipated volume of coal fines in <br />a slurry form. Ordinarily a small volume is produced and the <br />slurry is quickly settled out in the closed water circuit for <br />the preparation plan[. However, because of the increase in the <br />volume of fines, Dorchester was required to modify r:he syste m <br />and utilize its settling pond as a slurry dewatering faci7.i[y. <br />A pump was installed to return the water to the preparation plant <br />system thereby creating an extended closed circuit and precluding <br />discharge. The pond is dredged on a continuous basis and the <br />settled fines have been placed in a holding area at the refuse <br />dump. <br />The refuse dump has been constructed pursuant to an engineered <br />plan prepared by Geotech, Inc. and submitted to your office. <br />That plan sets forth a method of placement for our "coarse" <br />reject material and provides a supporting stability analysis. <br />
