• premining conditions. <br />No erosional features were noted in any of the areas inspected by the inspection team. <br />4. Sedimentation Ponds <br />Four sedimentation ponds continue to treat runoff from the azeas of this partial Phase II bond release. <br />Although the demonstration results indicate that there is no more erosion from the subject reclaimed <br />areas than that previous to mining, runoff from these areas is combined with runoff from other azeas <br />of unreclaimed disturbance. <br />5. Bonding <br />The Division currently holds a performance bond(s) of $16,000,000. No reduction in bond was <br />requested in this bond release application. The release documents release of liability for the <br />accomplished work. The Division estimates its cost to complete remaining reclamation work at the <br />site to be $14,102,823. The $16,000,000 is sufficient to assure completion of the remaining <br />reclamation work at the site if the work had to be performed by the Division, including the cost of <br />reestablishing vegetation on any revegetated areas, should those azeas fail. <br />• 6. Summary and Conclusions <br />Based upon a review of the mine permit, the applicant's bond release (SL-03) application, and site <br />inspections, the Division finds, for the SL-03 azeas described (see 1999 Annual Report Exhibit 9, <br />2/11/00), that Colowyo Coal Company, L.P. has replaced topsoil in accordance with the approved <br />reclamation plan. Colowyo Coal Company, L.P. has established vegetation that supports the approved <br />post mine land use and meets the approved success standazd for vegetative cover. The Division finds <br />that the reclaimed area subject to this bond release is not contributing suspended solids to streamflow <br />or runoff outside the permit azea in excess of premining levels or in excess of adjacent nonmined <br />areas.
