Russell Means, Environmental Protection Specialist, RE: Request for Appointment of Pre-hearing Conference Officer, Cotter Designated Mining Operation Appeals. The Mined Land Reclamation Board has received appeals of the Division's findings in regard to DMO status for four Cotter mines. Cotter is appealing the DMO designation for the JD-6, JD-8 and JD-9 mines. An environmental coalition is appealing the Division's findings that the SM-18 Mine is not a DMO. Per the Board's direction aPre-Hearing Conference shall be held prior to the Formal Public Hearing. A Board approved Stipulated Motion approved on July 11t", 2007 sets dates for final reviews, responses and the date for the Formal Public Hearings. The Formal Public Hearing has been scheduled to occur during the October 17`" and 18th, 2007 Board meeting. Sandy Brown has indicated that she will be available to preside as Pre-hearing Conference Officer for aPre-hearing Conference during the available dates. Staff respectfully request that Sandy Brown be appointed as Pre-hearing Conference Officer for the Cotter DMO Appeals. Sincerely, /~- G.
