Cottony <br />Division Director <br />Natural Resource trustee <br />During the February 14-15, 2007 Board meeting, the Board will consider a petition for <br />administrative appeal submitted by Jack Nickerson, of URS Corporation, on behalf of Rocker <br />Construction. Rocker Construction is the Applicant for the Rocker Gravel Pit application. The <br />petition seeks to overturn staff's interpretation that a newly proposed access road for the Rocker <br />Gravel Pit constitutes "affected land" as defined by Construction Materials Rule 1.1(3) and <br />Section 34-32.5-103(1 } C.R.S. <br />Please review the enclosed documents, which include: <br />dated January 5, 2007, in which the Applicant indicated "road access changes" to the <br />original application; <br />Notice from Rocker Construction to the Soil Conservation, dated January 5, 2007, in <br />which the Applicant indicated "road access changes" to the original application; <br />Correspondence from DRMS to Rocker Construction, dated January 12, 2007; <br />Correspondence from URS Corporation, on behalf of Rocker Construction, addressed to <br />DRMS and dated January 25, 2007 (Petition for Administrative Appeal); <br />Correspondence from Rocker Construction, dated January 24, 2007, appointing Jack <br />Nickerson with URS Corporation as agent for the Rocker Gravel Pit; and <br />Map of Access Corridor, Rocker Construction, dated January 23, 2007, showing the <br />newly proposed access road in yellow. <br />Notice from Rocker Construction to the La Plata County Board of County Commissioners, <br />End of memo. <br />Office of Office of <br />Mined Land Reclamation ~ Active and Inactive Mines <br />
