A copy of that request has been included for <br />your reference. <br />On October 6, 1980, the U. S. Geological Survey issued <br />an order requiring Energy Fuels to recover and stockpile Lennox <br />coal. On November 7, 1980, EFC filed a Notice of Appeal to the <br />Director of the United States Geological Survey from the October <br />6, 1980 Survey Order. <br />After review of that appeal, the Geological Survey, by <br />the enclosed letters dated March 24 and March 26, 1981, lifted <br />its order requiring Lennox recovery and further granted EFC's <br />request for permission to spoil non-merchantable Lennox coal. <br />
