Mrs. Ann Tatum -2- April 18, 1995 <br />items as they are submitted, and determine whether they are in compliance with regulatory <br />requirements. The Division, in addition, conducts inspections of mine sites, and requests operators to <br />correct inconsistencies between maps, designs, etc., when those deficiencies are observed by Division <br />personnel. Finally, permits are reviewed every two and a half years to ensure regulatory and technical <br />adequacy. <br />LYhen inaccuracies or mistakes are discovered but are considered inconsequential, the mine is notified <br />to correct these mistakes. If inaccuracies are significant and the Division determines that the <br />inaccuracy may result in harm to the environment or public, then enforcement action may betaken. <br />You identified that your barn that was constructed in 1992 was not located on the structural <br />inventory map that was submitted in March of 1994. The Division determined your barn is in an area <br />that is protected from subsidence and that its omission from the map was not significant enough to <br />warrant an enforcement action. The Division did feel that a modification to the permit was required <br />to ensure compliance with the regulations. Basin Resources was informed that a barn was mislocated <br />on the structural inventory map. Basin has responded and has submitted a minor revision to move the <br />location structure #26, 500 feet to the northwest. <br />The stipulation that you refer to, No. 66, was part of the original January 1994 proposed decision of <br />the Division to approve the permit renewal of the Golden Eagle Mine. The intent of that stipulation <br />was to identify those structures located in and around the 5-year mine plan that are in areas that will <br />be subsided or could be affected by subsidence and to ensure their protection. Between the January <br />proposed decision and the Board's final decision in May 1994, the operator submitted the information <br />requested in the stipulation. The stipulation was complied with and not made a part of the final <br />decision. The Division does not place stipulations upon permits to correct submitted information; we <br />request the information be corrected in the form of a revision to the permit, which has been done in <br />this case. <br />4) Wilh regards to Stiprtlatiotr 70 -have yort forwarded a copy of the corrtirrge»cy plan <br />submitted by Basin which resrdted in this Stipu/alias being termuraled? <br />No, a contingency plan was not forwarded. My review of the records show that the Division <br />accepted as an adequate response changes to pages 2.05-54 and 2.05-59 (enclosed). <br />5) Slipnlalion 71 -isn't our barn is ur the S00 font hujjer znne~ }ou slate Thal the mine is in <br />compliance with Stipulation 72 -how can the mine be in compliance with Stipulation 72 when <br />several strucarres do nor appear on Map 16? Please advise. <br />Stipulation 72 reads: <br />Basin Resources will conduct on a quarterly basis an on-the-ground survey for the <br />existence of structures in (1) the areas anticipated to be undermined in the ensuing <br />three months, (2) the areas anticipated to be affected by the resultant subsidence, and <br />(3) the 500-foot bufTer zone beyond the areas anticipated to be affected by the <br />subsidence. <br />
