Section R <br />The following findings and specific approvals are required by Rule 4: <br />I. Roads -Rule 4.03 <br />A. Haul Roads <br />1. The applicant has provided relevant information concerning the pre-1995 <br />constructed haul road that shows the road meets the performance standards of <br />Rule 4.03.1 <br />2. The Division proposes to approve the retention of the haul road depicted on Map <br />No. C-4 since it is compatible with the approved post-mining land use, and a <br />request for its retention was submitted by the landowner. (4.03.1(l)(t)(I)). <br />B. Access Roads <br />1. The landowner has requested the retention of the access road depicted on Map <br />No. C-4. It's retention is compatible with the approved post mining and <br />historic land use of agriculture (ranching). Therefore the Division proposes to <br />approve retention of the access road. (4.03.2(l)(f)). <br />II. Support Facilities -Rule 4.04 <br />Information on mine support facilities is found in Section 2.05.3 of the permit and are <br />depicted on Map C-4. The landowner has requested in writing that some of the buildings <br />remain after reclamation to support his agriculture operation. A summary is found in the <br />Summary Section of this document under "Description of Operations and Reclamation <br />Plan". Specific findings for Rule 4.04 aze not applicable. <br />III. Hydrologic Balance -Rule 4.05 <br />A. With the exception of the Small Area Exemption listed below, all disturbed area <br />drainage passes through one of two existing sediment ponds. Discharges from these <br />ponds aze monitored to verify compliance with water quality standard and effluent <br />limitations (4.05.2(2)). <br />1. The Division proposes to grant a small area exemption from use of sediment <br />ponds due to the limited size of the area and due to the fact that ponds and <br />treatment facilities aze not necessary for the drainage to meet the effluent <br />limitations of Rule 4.05.2 and applicable State and Federal water quality <br />standards for receiving streams and also due to the tact that no mixing of surface <br />drainage with a discharge from underground workings will occur. The small <br />area to be exempted is located between the mine entrance gate and the east pond <br />13 <br />
