Upon the resolution of any timely <br />filed and served objections to the CF&I Settlement Motion, the <br />hearing may be stricken and the relief sought in the CF&I <br />Settlement Motion may be granted without further notice or <br />hearing. <br />It is the business judgment of CF6I that 1) the Honnen <br />Equipment Settlement Agreement is in the best interest of the <br />Debtor's estate and its creditors, and 2) that the estate will be <br />spared litigation expense and further delay respecting the <br />outcome of such litigation if the Honnen Equipment Settlement <br />Agreement is approved. <br />3 <br />
