We do <br />not believe that this road will last until Mr. Kessler can start work; <br />one rain will cause severe washing of the highwall on the road. In <br />addition to destroying the road, there will be destruction of the <br />reclamation being completed on the hill. We believe that the Division <br />has wasted money to pay for elimination of the original road and then <br />pay to cut another road into the reclaimed hill, particularly since the <br />second road leaves the exposed shale highwall. <br />In my last conversation with Energy Fuels, they are not satisfied with <br />the present status of the road below Chen's Hill. That road to too <br />narrow with no room to place a ditch to maintain the road. Runoff will <br />cause continual damage to the road and cross directly into their <br />sediment pond. The effect of the new road along Magpie Creek is still <br />another unknown added to the effect of the material that was recently <br />pushed down the hill to reduce the slope. <br />Finally, your statement regarding the source of funding the various <br />projects in the West Pit is interesting. Perhaps you can inform me how <br />you can alter the agreement to now say that Harrison Western funds will <br />by used for the drainage improvement and not erosion repair.
