Productivity was a criteria for the reclamation of the entire 355 acres of disturbed lands on the <br />original mine site, but not a criteria for the (isolated) shrub enhancement or slump stability <br />parcels. <br />Eligibility for Phase III Bond Release <br />At the Hayden Gulch Mine, a Phase III bond release can occur: <br />]) No less than 10 years after the last yeaz of augmented seeding, fertilizing, irrigation <br />or other work33. An earliest eligible date for the shrub pazce(s is June 5, 2001. The <br />eazliest eligible date For the slump area is September 2004.34 <br />2) When the permittee has successfully completed all surface coal mining reclamation <br />operations in accordance with the approved reclamation p1an.35 <br />3) When all reclamation requirements of the Rules and the Act aze fully met.36 <br />4) When the final inspection procedures of Section 3.03.2 have been satisfied.37 <br />IV. OBSERVATIONS AND FINDINGS <br />The woody plant density standard was achieved for the pazcels, and the cover standard was <br />achieved as well. The diversity standard was not met as written in the permit for the shrub <br />enhancement and slope stability pazcels. However, these 8.9 acres are a very small portion of the <br />overall reclaimed area of the HG Mine.
