THE <br />VEGETATION COVER STANDARD OF 20% AS PROPOSED AND DISCUSSED ON PAGES 118 <br />AND 118A OF THE APPLICATION SHALL BE REVISED WITHIN ONE MONTH OF PERMIT <br />ISSUANCE. <br />Following final construction of the underground development waste pile and <br />final grading in the portal and facilities areas, reclamation will consist of <br />topdressing with available soil material as discussed in the previous section, <br />followed by ripping, discing, broadcast seeding and straw mulching. Mulch <br />will be applied at 2 tons per acre and crimped into the soil. Fertilizer will <br />be applied based on fertility analyses obtained at the time of reclamation. <br />The seed mix contains one shrub, four wing saltbush, and a number of bunch <br />grasses, sod farming grasses, and 2 leguminous forbs. <br />In the case of one grass (bluegrass) and two forbs (buckwheat and lupine) the <br />species to be planted is not listed. The following stipulation is necessary: <br />STIPULATION N0. 6 <br />WITHIN ONE MONTH OF PERMIT ISSUANCE, THE APPLICANT'S SEED MIX WILL BE <br />REVISED TO LIST ADAPTED SPECIES OF BLUEGRASS, BUCKWHEAT AND LUPINE, OR <br />ACCEPTABLE SUBSTITUTES. <br />Pursuant to Rule 2.07.6(2}(n}, on the basis of vegetation information supplied <br />by the applicant and the fact that areas to be disturbed have been previously <br />disturbed by coal mining, the Division finds that the proposed activities <br />would not affect the continued existence of any endangered or threatened <br />species or result in the destruction or adverse modification of their critical <br />habitats. <br />XIII. Fish and Wildlife -- Rules 2.04.11, 2.05.6(2) and 4.18 <br />The fish and wildlife resources section has been reviewed by the Division. <br />The fish and wildlife section can be found on page 77 of the application. <br />
