US Army Corps <br />of Engineers <br />Sacramento District <br />650 Capitol Mall <br />Sacramento, CA 95814 <br />Public <br />Public Notice No. 9119 <br />In Reply Refer to: SPKCO-O <br />tice <br />Date: October 1, 1985 <br />Comments Due by: October 31, 1985 <br />JOINT PUBLIC NOTICE <br />U.S. ARMY, CORPS OF ENGINEERS, SACRAMENTO DISTRICT <br />AND <br />STATE OF COLORADO, DEPARTMENT OF HEALTH <br />TO WHOM IT MAY CONCERN: <br />Subject: Application for a Department of the Army Permit under Section 404 0( the Clez~n Water Act <br />(CWA) and for water quality certification under Section 401 of the CWA to place dredged and/or fill <br />material in the Animas River, as shown on the attached drawings. <br />Applicant: Jack D. Williams, Agent, Animas Aggregates Inc., P.O. Box 1447, Durango, Colorado 81302. <br />Location: The project site is located in the Animas River, approximately 12 miles north of Durango, La <br />Plata County, Colorado, within Section 36, Township 37 North, Range 9 West. <br />Background: On April 1, 1980, the U.S. Army Corps of Engineers, Sacramento District, issued <br />Department of the Army Permit No. 6998 to Animas Aggregates Inc. This permit authorized placement of <br />approximately 3,000 cubic yards of dredged material for restoration of dikes and placement of large <br />boulders in areas of critical erosion potential. Subsequent years of high flows have since eroded much of <br />the existing dikes and banks. The applicant is requesting a Department of the Army permi¢ in order to <br />restore existing dikes, construct a new dike, and to place riprap along a north bank of the Animas River. <br />Purpose: To prevent further erosion to the east bank of the Aniimas River, to prevent flooding of <br />residential, pasture, and development land adjacent to the east bank, and to protect wastewater treatment <br />ponds on an exposed northern bank. <br />Project Destription: The applicant proposes to restore two dikes and to construct a new dike by <br />placement of approximately 16,200 cubic yards of dredged and/or fill material in the Animas River. Areas <br />of critical erosion potential will be riprapped with concrete slabs. Approximately 75 cubic yeirds of large <br />boulder or precast concrete slab riprap will be placed on a northern bank to protect wastewater treatment <br />ponds. <br />Additional Information: The applicant has requested water quality certification from the State of <br />Colorado, Department of Health in accordance with Section 401 of the Clean Water Act. Written <br />comments on water quality certification should be submitted to Mr. Rich Horstmann, Planning and <br />Standards Section, Colorado Department of Health, 4210 East 11th Avenue, Denver, Colorado 40220, on or <br />before the expiration date of this public notice. <br />Written comments on this permit application should be submitted to the Sacramento District Engineer at <br />the address listed above. Please furnish a copy of your written comments to Regulatory Unit 4, U.S. Army <br />Engineer District, Sacramento, 2784 Crossroads Bou levard, Suite 207, Grand Junction, Colorado 81506-3975. <br />The latest published version of the National Register of Historic Places and its monthly supplements have <br />been reviewed and there are no places either listed or recommended as eligible which would I>e affected. <br />No further cultural resources review is warranted because the permit area has been created in modern <br />times. This activity would not affect any threatened or endangered species or their critical h abitat. The <br />District Engineer has made this determination based on information provided by the applicant and on the <br />Corps' preliminary evaluation. <br />Interested parties are invited to submit written comments on or before October 31,1985. Any I>erson may <br />request, in writing, within the comment period specified in this notice that a public hearing be held to <br />consider this application. Requests for public hearings shall state, with particularity, the seasons for <br />holding a public hearing. <br />
